2. Ownership and Copyright
All content on DesignBub’s website, including text, images, graphics, designs, logos, and other materials, is the exclusive property of DesignBub. Unauthorized use, reproduction, or distribution of any content from our site is strictly prohibited. We respect intellectual property rights and expect our users to do the same.
3. Client Responsibilities
To ensure timely delivery of services, clients must provide all necessary content, materials, and information within 40 days of placing the order. Delays in providing these materials may result in project delays or cancellation. Clients are responsible for ensuring that all content provided does not infringe on any third-party rights.
4. Payment Terms
The project agreement’s specified payment schedule must be followed when making payments. We won’t move on with the project or website hosting if there is an unpaid balance until all funds have been received. If payments are not received on time, DesignBub retains the right to suspend or discontinue services.
5. Changes to Services
If you require changes to your project or services after the initial agreement, please notify us within 3 days. Changes may impact the project timeline and pricing. We will communicate any adjustments to the project scope and cost as necessary.
6. Cancellation Policy
In the event of an order cancellation after placement, a cancellation fee of 50% of the total project cost will apply. For domain transfers or redemptions, half of the total domain and hosting fees will be charged. Cancellations must be communicated in writing to be processed.
7. Data Backup and Hosting
If your hosting plan is not renewed, DesignBub will retain a backup of your data for up to 7 days post-expiration. After this period, your data will be deleted, and DesignBub will no longer maintain backups. It is recommended to renew your hosting plan promptly or keep a personal copy of your data.
8. No Warranty
DesignBub does not guarantee the availability of data backup if hosting expires or if you switch to third-party hosting services. We are not liable for any loss of data or service disruptions caused by delays in client responses or third-party issues. DNS propagation times may vary, typically between 24 to 48 hours, and in rare cases, up to 72 hours.
9. Intellectual Property Rights
DesignBub retains all rights to the designs and graphics created for you until full payment is received. Once payment is complete, the client will own the final designs. However, DesignBub reserves the right to showcase completed projects in our portfolio and promotional materials.
10. Revisions and Approval
The client is entitled to a specific number of revisions as outlined in the project agreement. Additional revisions beyond the agreed limit may incur extra charges. It is the client’s responsibility to review and approve the work at each stage to ensure that the final product meets their expectations.
11. Use of Client Content
By providing content to DesignBub, clients grant us permission to use, reproduce, and modify their content solely for the purpose of completing their project. DesignBub will not use client content for any other purpose without explicit consent.
12. Confidentiality
DesignBub will make every effort to protect the confidentiality of client information. We will not disclose any confidential information provided by the client to third parties without the client’s consent, except as required by law.
13. Limitation of Liability
DesignBub is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our liability is limited to the maximum extent permitted by law and does not exceed the total amount paid by the client for the specific project in question.
14. Termination of Services
DesignBub reserves the right to terminate services if the client breaches these terms and conditions or engages in unlawful or unethical behavior. In such cases, any outstanding payments will remain due, and the client will not be entitled to a refund.
15. Amendments to Terms
DesignBub may update these terms and conditions from time to time. Any changes will be posted on our website, and it is the client’s responsibility to review these terms periodically. Continued use of our services after changes are made constitutes acceptance of the revised terms.
