Terms and Conditions

These terms govern use of the DesignBub website and the purchase and delivery of our creative, website, development, automation, subscription and digital-shop services.

Please read before ordering

By using this website, accepting a proposal or quotation, paying an invoice or placing a Creative Shop order, you agree to these terms. Important project-specific terms will also appear in your proposal, statement of work, order confirmation or invoice.

1. Agreement and Document Priority

These Terms and Conditions form an agreement between you or the organisation you represent (the “Client”, “you” or “your”) and DesignBub (“DesignBub”, “we”, “us” or “our”). If you act for an organisation, you confirm that you are authorised to bind it.

If documents conflict, the following order generally applies: (1) a signed master agreement or statement of work; (2) an accepted written proposal or order confirmation; (3) the relevant invoice; and (4) these Terms and Conditions. A written project document may expressly change this order.

2. Eligibility and Authority

You must be at least 18 years old and legally able to enter a binding agreement. You must provide accurate information and may not place an order or use an account for another person or organisation without authority.

3. Our Services

DesignBub may provide branding, graphic design, UI/UX, websites, ecommerce, SaaS, applications, MVP development, AI automation, motion graphics, video, 3D animation, creative subscriptions, digital products and related consulting or production services.

Website descriptions, samples, portfolio items and estimated outcomes are illustrative. The exact scope, number of concepts, revisions, formats, functionality, integrations, delivery method and support period are those confirmed in the applicable project documents.

4. Quotes, Orders and Acceptance

  • A quotation or proposal is valid for the period stated in it and may be revised if the scope, assumptions, schedule or third-party costs change.
  • A website checkout or automated acknowledgment confirms that we received your request; it does not always mean that we have accepted the project.
  • An order is accepted when required payment is verified and we confirm the scope or begin work.
  • We may decline or cancel an order before work starts if it is unlawful, outside our capabilities, based on incorrect pricing, conflicts with these terms or cannot reasonably be delivered.
  • If we decline an order after receiving payment and before starting work, we will return the amount received for the declined service, subject to unavoidable payment-provider charges where permitted by law.

5. Client Responsibilities

You agree to:

  • Provide complete and accurate briefs, files, dimensions, content, technical information and access reasonably required for the work.
  • Appoint a decision-maker and provide consolidated, timely feedback and approvals.
  • Confirm that you have the necessary rights and permissions for all materials, trademarks, data and instructions supplied to us.
  • Review deliverables, copy, legal statements, prices, claims and functionality before approval or publication.
  • Maintain backups of your own systems, files and credentials and use secure methods when sharing access.
  • Use deliverables lawfully and comply with platform, advertising, consumer, accessibility and industry requirements that apply to your business.

Delays, rework or additional cost caused by incomplete information, changing instructions, unavailable access or late feedback may extend the schedule and require a revised quotation.

6. Fees, Payments and Taxes

  • Prices, currency, deposits, milestones and due dates are shown in the checkout, proposal or invoice. Unless stated otherwise, listed Creative Shop prices are in United States dollars.
  • Payments may be made through Payoneer, bank transfer or another method we approve. A manual payment is complete only after funds clear and DesignBub verifies the reference.
  • You are responsible for bank, currency-conversion, intermediary and payment-provider charges unless the written quotation states otherwise.
  • Deposits and milestone payments reserve production capacity and may be non-refundable once the related work has started.
  • We may pause work, access, delivery or support while an amount is overdue. A pause may change the delivery schedule.
  • You are responsible for applicable taxes, duties or withholding obligations unless DesignBub is legally required to collect them. If tax must be withheld, you will provide the required certificate and cooperate on proper documentation.

7. Creative Shop and Digital Packages

Creative Shop packages are professional digital services or digital deliverables, not physical goods, unless a product page expressly says otherwise. Each page lists the included scope, approximate turnaround, revision allowance and intended deliverables.

  • Extra concepts, pages, formats, variations, advanced functionality, stock assets, copywriting or accelerated delivery are quoted separately unless listed as included.
  • Production begins after required payment, brief, content and assets have been received.
  • Delivery may be through email, the client portal, cloud link or another agreed digital method.
  • You should download and safely back up delivered files. We do not promise indefinite storage after the support or archive period.
  • Product images and mockups demonstrate presentation and style; exact output depends on the purchased package and approved brief.

8. Subscription Services

If you purchase a monthly or recurring service, the plan description or proposal will specify the billing cycle, active-request limits, task queue, communication method, pause rules and included capabilities.

  • A subscription renews only as described at purchase or in the signed plan. You may cancel future renewal by giving notice before the next billing date.
  • Unused production time, requests or capacity do not roll over unless the plan expressly allows it.
  • Turnaround estimates depend on request complexity, the active queue, timely feedback and available client materials.
  • Work requested outside the plan, third-party costs and specialist production may require a separate fee.
  • Cancellation stops future billing but does not reverse charges for a current period in which capacity was reserved or work began, except where mandatory law requires otherwise.

9. Timelines and Delivery

Turnaround dates are good-faith estimates unless a signed project document expressly makes a deadline binding. Timing normally starts after the required payment, complete brief, assets and access are received.

Client delays, new requirements, revision rounds, third-party approvals, platform reviews, technical dependencies and events outside our control may extend delivery. We will communicate material changes and, where appropriate, agree a revised schedule.

10. Revisions and Change Requests

A revision refines work within the approved brief and design direction. A new concept, changed strategy, new content, additional page, added functionality, altered dimensions, extra format or request made after approval may be treated as a change in scope.

  • Included revision rounds are stated in the package or proposal.
  • Feedback should be clear, consolidated and supplied within a reasonable review period.
  • Unused revisions have no cash value and do not transfer to another project unless agreed.
  • Additional revisions or scope changes may require approval of a new fee and schedule before work continues.

11. Review, Testing and Acceptance

You must review previews and test final deliverables in the intended environment before publication. A deliverable is accepted when you approve it in writing, publish or use it commercially, or fail to report a material issue within the review period stated in the project documents.

Where no period is stated, notify us of a reproducible material defect within 10 business days of final delivery. Correction of a defect that fails the agreed specification is different from a preference change, new request, third-party issue or expanded scope and may be handled separately.

12. Cancellation and Refunds

Because creative and development services reserve team capacity and often produce custom work, the following rules apply unless a project document or mandatory law gives you better rights:

  • Before production starts, an eligible payment may be refunded less non-recoverable payment charges, purchased assets and administrative costs.
  • After production starts, completed work, reserved time, approved milestones, source preparation and third-party costs are payable and non-refundable.
  • For a cancelled custom project, any refund or balance is calculated from work completed, committed costs and amounts already paid.
  • A Creative Shop package becomes non-refundable once custom production or delivery has started, except for a verified failure to provide the purchased service.
  • Subscription fees for a current billing period are non-refundable once capacity has been reserved or work has started. Cancellation prevents future renewal where applicable.
  • If DesignBub materially fails to provide an accepted service and cannot reasonably correct the issue, the available remedy may be re-performance or a proportionate refund for the affected, undelivered portion.

Nothing in these terms removes a cancellation, refund, conformity or other consumer right that cannot legally be excluded in your country.

13. Intellectual Property and Ownership

Final approved deliverables

After full payment, you receive the ownership or licence expressly stated in the project documents for final approved custom deliverables. If the documents do not specify, DesignBub grants the Client a worldwide, perpetual licence to use the final deliverable for its intended business purpose, subject to any third-party terms.

What DesignBub retains

Unless expressly transferred in writing, DesignBub retains ownership of proposals, unused or rejected concepts, drafts, working files, internal methods, know-how, templates, design systems, reusable components, pre-existing code, libraries, tools and processes. Source or editable files are included only when listed as a deliverable.

Third-party materials

Fonts, stock media, plugins, open-source software, platform components and other third-party materials remain subject to their own licences. You are responsible for ongoing licence, hosting or subscription fees that are identified as Client costs.

Portfolio use

Unless prohibited by a confidentiality agreement or written project term, DesignBub may identify the Client and display completed public work in its portfolio, website, social media, awards and proposals. We will not intentionally reveal confidential information.

14. Client Content and Instructions

You retain ownership of materials you provide. You grant DesignBub and its authorised team a limited licence to host, copy, edit, adapt and use those materials only as needed to quote, produce, deliver, support and showcase the work as permitted by these terms.

You confirm that Client materials and instructions do not infringe intellectual property, privacy, publicity, confidentiality or other rights and are not unlawful, deceptive or harmful. We may refuse content or instructions that create legal, ethical, security or platform risk.

15. Third-Party Platforms and Services

Projects may rely on hosting companies, payment providers, domains, app stores, plugins, APIs, AI systems, social networks, ecommerce platforms, analytics, stock libraries or other external services. Their terms, prices, availability, review processes and privacy practices are outside DesignBub's control.

We are not responsible for a third party's outage, policy change, account suspension, security incident, rejection, data loss, price change or discontinuation. We may recommend an alternative or quote migration work, but cannot guarantee compatibility or uninterrupted availability.

16. AI-Assisted Work and Automation

DesignBub may use AI-assisted tools for research, ideation, drafting, asset exploration, code support, automation or quality checks where appropriate. Human review and the agreed project process remain important, but we cannot guarantee that every generated element is unique or that a third-party AI service will remain unchanged.

You must independently validate high-risk or regulated uses, important factual claims, decisions affecting individuals and outputs used as legal, medical, financial, employment, safety or compliance advice. Unless expressly agreed, our deliverables do not replace qualified professional advice.

17. Confidentiality

Each party will use reasonable care to protect non-public business, technical and commercial information received from the other and will use it only for the project or business relationship. Confidentiality does not cover information that is public without breach, already lawfully known, independently developed or lawfully received from another source.

Disclosure is permitted to team members, contractors and professional advisers who need the information and are subject to confidentiality duties, and where law or a valid authority requires disclosure. A separate non-disclosure agreement controls if it sets stricter terms.

18. Service Standards and Disclaimers

DesignBub will perform services with reasonable professional care and will use reasonable efforts to deliver the agreed scope. Except for express commitments in a signed project document and rights that cannot be excluded, services and website content are provided “as is” and “as available”.

We do not guarantee a particular search-engine ranking, traffic level, approval, revenue, conversion rate, sales result, funding result, platform acceptance, uninterrupted website operation or business outcome. Marketing and technical results depend on factors outside our control, including the Client's offer, budget, implementation, competitors, platforms and market conditions.

19. Limitation of Liability

To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, punitive or consequential loss, or loss of profit, revenue, opportunity, goodwill or data, arising from these terms or the services, even if the possibility was known.

To the maximum extent permitted by law, DesignBub's total aggregate liability relating to an affected project or service will not exceed the fees actually paid to DesignBub for that affected project or, for a continuing subscription, the fees paid for the affected service during the six months before the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited, including liability for fraud or wilful misconduct and any mandatory consumer rights.

20. Client Indemnity

To the extent permitted by law, the Client will defend, indemnify and hold DesignBub harmless from third-party claims, losses and reasonable costs arising from Client materials or instructions, unlawful or unauthorised use of deliverables, infringement caused by Client content, or the Client's material breach of these terms. This does not apply to the extent a claim was caused by DesignBub's unauthorised change or misconduct.

21. Acceptable Use and Security

You may not use the website, portal, deliverables or services to:

  • Break the law, infringe rights, mislead users or distribute harmful or abusive content.
  • Probe, bypass or interfere with security, accounts, rate limits, access controls or infrastructure.
  • Upload malware, steal credentials, scrape protected information or disrupt another user.
  • Resell, copy or exploit DesignBub templates, tools or protected materials beyond the licence granted.
  • Use automation or AI deliverables to make prohibited or unreviewed high-impact decisions.

22. Suspension and Termination

Either party may terminate a continuing engagement according to its project documents. DesignBub may suspend or terminate access or work for material non-payment, unlawful use, security risk, abusive conduct, repeated failure to cooperate or material breach. Where reasonably possible, we will provide notice and an opportunity to correct a remediable breach.

On termination, accrued payment obligations remain due. Clauses that logically continue—including confidentiality, intellectual property, payment, disclaimers, liability, indemnity and dispute terms—survive termination. Delivery of paid, completed work remains subject to these terms and any security or legal restriction.

23. Events Beyond Reasonable Control

Neither party is responsible for delay or failure caused by events beyond reasonable control, including natural disaster, widespread internet or power outage, war, civil disturbance, labour disruption, epidemic, government action, supplier failure or major platform incident. The affected party will use reasonable efforts to reduce the impact and resume performance. Payment remains due for work already completed and committed third-party costs.

24. Governing Law and Disputes

The parties will first try in good faith to resolve a dispute through written notice and direct discussion. Unless a signed project agreement says otherwise, these terms are governed by the laws of Pakistan, and the courts located in Lahore, Punjab, Pakistan will have jurisdiction.

If you are a consumer, this clause does not remove any mandatory protection or right to bring a claim in another court that applicable consumer law does not allow you to waive.

25. General Terms

  • Changes: we may update website terms for future use or orders. Existing accepted projects remain governed by the terms applicable when accepted unless both parties agree otherwise or a legal change requires an update.
  • Severability: if a provision is unenforceable, it will be limited or removed only to the minimum necessary, and the remaining terms continue.
  • No waiver: delay in enforcing a right does not waive it.
  • Assignment: you may not transfer the agreement without our written consent. We may assign it as part of a business reorganisation or sale, subject to applicable law.
  • Independent parties: nothing creates employment, partnership, agency or joint venture between the parties.
  • Entire agreement: the applicable project documents and these terms form the full agreement about their subject and replace earlier discussions about that scope.
  • Electronic communications: email, portal messages, electronic acceptance and payment confirmations may be used for notices, approvals and records, except where law requires another method.
